Members of the Mexican Front in Defense for Decent Housing. B.C. (FMDVD) in extraordinary assembly

Time is the best space that has to be traveled with reason: social, economic, and legal. The FMDVD celebrates fifteen years of fighting in the constitutionally established courts

Justice for the Falsely Accused

We beat the financial capital oligarchies of the mortgage companies, mainly Patrimony, ING Hipotecaria, Hipotecaria Su Casita, Crédito y Casa, Metro Financiera, and Hipotecaria Bancomer, Banamex and Banorte, among others.

We also defeated the structure of the criminal economy of construction companies such as: Urbi Desarrollos Urbanos, Geo, Ara, Homex, Sadasi, Promotora de Vivienda Integrales-Vinte, K Desarrollodora, criminal business organizations responsible for the failed vision of housing in Mexico.

False Guilty and Fabricated Crimes

They always denied that there were false culprits for the fabrication of high-impact crimes in the adversarial criminal system. They even wanted to impose the ambiguous definition of those “unjustly imprisoned”, this ideological position assumes that the punitive system is unjust.

When it is the opposite after the constitutional reform of security and justice of June 18, 2008, in Mexico a perverted penal system was created and using all the force of the State they took thousands of guilty prisoners to prison even though they were innocent.

Bishop José Raúl Vera López, and the lawyer José Humbertus Pérez Espinoza.

The fabrication of crimes was recognized by the Ministers of the SCJN in Amparo in Review 4/2022, which was resolved on December 8, 2022 by unanimous vote of the eleven votes.

The vote of the majority of the ministers established Jurisprudence by Mandatory Precedent.

The Jurisprudence by Mandatory Precedent with digital registration number 2027796 and whose title is: “ADEQUATE DEFENSE. ITS EXERCISE INCLUDES THE POSSIBILITY OF RAISING ARGUMENTS AIMED AT QUESTIONING THE BAD FAITH OR THE ANIMALITY OF THE JUSTICE PROCUREMENT AUTHORITIES IN THE INSTRUCTION OF THE PROCESS”, and we highlight what is stated by the eleven ministers and which says the following:

José Humbertus Pérez Espinoza (activist and human rights defender):

“Justification: A criminal proceeding that respects due process – and is genuinely interested in the historical truth – must allow the defense to freely allege and prove that the prosecution acts with the intention of fabricating guilty parties. It is not alien to the nature of an oral trial hearing to discuss acts that could indicate animosity or bad faith on the part of the law enforcement authorities.”
